What should I check in an employment offer letter?

Check the notice period (both sides), any employment bond amount and duration, non-compete geography and length, IP-assignment scope, variable-pay clawback triggers, and probation length. Confirm the joining bonus recovery timeline and whether stock options accelerate on termination.

Offers often quote a headline compensation number and hide the risk in the fine print. A 2-year bond with a ₹2 lakh recovery, a 3-month one-sided notice from you but 1 month from the company, and a broad non-compete can cost you six months of income if you leave. Are employment bonds legal and enforceable?

In India, bonds are enforceable only to the extent of actual documented training cost incurred by the employer — not as a penalty. In most US states, non-compete bonds are unenforceable or heavily limited. UK courts enforce restraints only if reasonable in scope and duration.

Courts routinely strike down bonds framed as penalties rather than reimbursement of real, documented expenses. Ask HR for the training cost calculation. How wide can a non-compete legally be?

Post-employment non-competes are largely unenforceable in India and California, and are limited to reasonable scope (usually 6–12 months, defined geography, specific competitors) in the UK, EU, and most other US states. Blanket 'shall not work in the industry' clauses rarely survive challenge.
